Bu makalede solipsizmin argümanlarının metafizik ve epistemolojik düzlemlerde geçerli olup olmadığı değerlendirilecektir. Bu çerçevede çalışmada ilk olarak solipsizmin şüphecilikle ilişkisi bağlamında tarihsel arka planı verilecek, Rene Descartes ve George Berkeley’in solipsizmin teorik açıdan derinleşmesini mümkün kılan savlarına da yer verilecektir. Ardından George Edward Moore ve Hilary Putnam’ın solipsizme karşı kullanılabilecek argümanları ele alınacak ve son olarak solipsizm eleştirel bir değerlendirmeye tabi tutulacaktır. Makalenin temel argümanı solipsizmin ne metafizik ne de epistemolojik açıdan gerekçelendirilebileceğidir.

La question des rapports du spinozisme à l’axiologie a fait l’objet de nombreux débats. Certains commentateurs considèrent Spinoza comme étant profondément immoraliste, alors que pour d’autres, il maintient l'ensemble des valeurs humaines. Spinoza a cherché à dépasser l’utilitarisme propre au conatus de chacun, afin de fonder un altruisme rationnel. Il souligne que le bien auquel l’homme aspire lorsqu’il suit la vertu, il le désirera aussi pour tous les autres hommes. Cependant, les moyens mis en œuvre pour démontrer cette thèse semblent (...) problématiques. Cet article analyse la logique de la coopération interhumaine élaborée par Spinoza, ainsi que son idéal de l’homme libre, montrant, qu'en fait, il n'a pas réussi à surmonter la nature profondément égoïste du conatus. -/- The question of the relationship between Spinozism and axiology has been the subject of much debate. Some commentators consider Spinoza to be profoundly immoralist, while for others he upholds the set of human values. Spinoza sought to go beyond the utilitarianism proper to the conatus of each person, in order to establish a rational altruism. He emphasizes that the good to which man aspires when he follows virtue, he will also desire for all other men. However, the means used to demonstrate this thesis seem problematic. This article analyzes Spinoza's logic of interhuman cooperation, as well as his ideal of the free man, showing that, in fact, he failed to overcome the profoundly egoistic nature of conatus. -/- . This is a reply to Vincent Carraud/René Verdon « Remarques circonspectes sur la mort de Descartes » (published in Revue du dix-septième siècle, n° 265, 2014/4, pp. 719-726, online: http://www.cairn.info/revue-dix-septieme-siecle-2014-4-page-719.htm, containing a critique of my "L'énigme de la mort de Descartes" Paris, 2011). I discuss the fatal illness and the death of Descartes, arguing that Descartes was very probably the victim of arsenical poisoning. The suspected murderer is a French priest, François Viogué, living with Descartes in 1650 at the French (...) embassy in Stockholm who may have seen in Descartes an obstacle to the hoped for conversion of queen Christina of Sweden. As against Carraud/Verdon I stress the medical facts, in particular the fact that Descartes himself seems to have suspected poisoning, since he asked for an emetic shortly before his death. (shrink)

No capítulo 1, “Do escudo de Aquiles à capa do Batman: o heroísmo togado e seus riscos à democracia”, discutimos a ascensão do protagonismo político no Poder Judiciário a partir da categoria antropológica do herói, expondo a delicada relação entre heroísmo e instituições democráticas. Para isso, traçamos um breve histórico do heroísmo e suas características, apresentando, posteriormente, uma analogia entre elas e a atuação do Ministro Joaquim Barbosa no curso da Ação Penal nº 470 do STF (Caso Mensalão). Tecemos também (...) alguns apontamentos sobre o Estado Democrático de Direito, a função do Poder Judiciário e os riscos que a propagação de escândalos públicos e a flexibilização de regras e princípios jurídicos podem trazer às instituições do Estado Democrático de Direito. O tema de fundo dessa análise é a relação simbiótica entre a violência e a produção mítica de heróis, segundo a teoria de Girard. No capítulo 2, “Satã: a violência na fundação da cultura”, analisamos a obra “Vejo Satã cair como um relâmpago”, de René Girard, apresentando sua teoria (mimética) e seu estudo antropológico da Bíblia e dos Evangelhos. O intuito é demonstrar a possibilidade de interpretar racionalmente dados antes percebidos como sobrenaturais, explorando, com Girard, as contribuições da revelação judaico-cristãs para a relação entre o homem, a violência e a organização político-religiosa do mundo antigo. O principal tema exposto na resenha é o da violência fundadora, base da cultura e da sociedade, que Girard identifica na figura bíblica de Satã. Mais do que mero símbolo religioso, Satã é a representação de um mecanismo de pacificação deflagrado em situações de crise social. Seu modus operandi consiste na reunião da sociedade contra um inimigo comum, um bode expiatório contra o qual levantam-se falsas acusações que sustentam sua perseguição e assassinato. Consideramos esse tema fundamental para a moderna e contemporânea compreensão dos processos de perseguição e vitimização político-social. A revelação cristã é a entrada em cena, no campo histórico, de um pensamento que se coloca francamente ao lado da vítima acusada pela comunidade. As ideologias penais da proteção do débil, os direitos individuais e os direitos humanos são efeitos políticos e jurídico do triunfo da cruz sobre a cultura satânica do assassínio de bodes expiatórios. No capítulo 3, “A violência no Direito: confissão e produção de bodes expiatórios”, aplicamos a teoria mimética para compreender o instituto jurídico da confissão do ponto de vista antropológico. Com base no Livro de Jó, investigamos a origem religiosa da extração forçada de confissões e demonstramos sua íntima relação com os rituais religiosos praticados na antiguidade, que usavam da assunção de culpa como um instrumento para legitimar a violência contra seus bodes expiatórios. Com isso, pretendemos apontar para a necessidade de mitigação do valor probatório da assunção de culpa no contexto de um Estado Democrático de Direito. Incorporada às intuições jurídicas, a confissão deve ser tomada como instrumento laico e totalmente desvinculado das práticas expiatórias que lhe deram origem. No capítulo 4, “Direito penal e preocupação pelas vítimas: a renovação dos princípios de ofensividade e proteção de bens jurídicos após a experiência do totalitarismo", analisamos o surgimento e desenvolvimento da ideia de crime como ofensa a bens jurídicos. Trata-se de um ensaio de história das ideias jurídicas em que traçamos a evolução histórica das ideias de ofensividade e proteção de bens jurídicos, desde sua gênese na experiência liberal e iluminista, passando por seu enfraquecimento durante o Direito Penal nacional-socialista, até culminar em seu ressurgimento e renovação nos dias atuais. O intuito desta análise é situar o princípio da ofensividade, enquanto garantia assegurada nas Constituições do Pós-guerra, no quadro histórico da moderna preocupação pelas vítimas, efeito cultural da religião cristã que discutimos no capítulo 2 (“Satã: a violência na fundação da cultura”). Por fim, no quinto e último capítulo, “O Direito após a revelação do mecanismo vitimário”, procuramos rematar a temática do Direito no quadro da antropologia de Girard, explorando o papel desempenhado pela revelação cristã do mecanismo expiatório na cultura ocidental, especialmente no que diz respeito à formação de uma ética de proteção das vítimas, eixo fundamental dos Direitos Humanos. Por isso, demonstramos como o Direito Penal, no ocidente, está dividido entre o sacrifício e o perdão. Resultado da lógica do cristianismo sacrificial, o moderno Direito constitui-se na forma híbrida de um Katéchon: ou seja, como racionalização do mecanismo vitimário, re-direcionado, por meio das instituições jurídicas e políticas, contra atos de perseguição de minorias e vulneráveis . The theoretical biology movement originating in Britain in the early 1930’s and the biosemiotics movement which took off in Europe in the 1980’s have much in common. They are both committed to replacing the neo-Darwinian synthesis, and they have both invoked theories of signs to this end. Yet, while there has been some mutual appreciation and influence, particularly in the cases of Howard Pattee, René Thom, Kalevi Kull, Anton Markoš and Stuart Kauffman, for the most part, these movements have developed (...) independently of each other. Focussing on morphogenesis understood as vegetative semiosis, in this paper I will argue that the ideas of these movements are commensurate. Furthermore, synthesising them would enable us to see life processes as proto-narratives. Doing so will involve synthesising biohermeneutics, Peircian biosemiotics with Waddington’s theoretical biology and Piagetian genetic structuralism, and this, I claim, would strengthen the challenge of these traditions to mainstream biology. At the same time, this should contribute to overcoming the opposition between the sciences and the humanities, developing a broader tradition of Schellingian thought which involves developing the humanities and then demanding of the physical and biological sciences that they are consistent with and can make intelligible the emergence of humans as conceived by the humanities. CISTOS OVÁRICOS Os cistos são cavidades anormais que às vezes possuem conteúdo de fluido biológico, ou podem ser cavidades ocas, com paredes sólidas refratárias à maioria dos compostos endógenos. Formam-se como alterações patológicas das células luteais ou foliculares do estroma ovárico. A presença de cistos altera o ciclo estral e obriga a (...) realização de tratamentos exógenos para remover o mesmo, fazendo com que a atividade cíclica da gônada retome sua normalidade (HATLER, et al. 2006). Alguns fatores de origem nutricional, tanto por deficiência de alguns compostos, como por excesso no fornecimento de outros, têm sido considerados como causas potenciais dos cistos, entre os principais fatores nutricionais podemos citar: 11.1 Fito-toxidade/fitoestrogênios Compostos vegetais, tais como plantas com elevado teor de flavonoides estrogênicos, encontram-se sob a forma de glicosídeos e têm a capacidade para modificar os processos reprodutivos devido à sua semelhança com os núcleos esteroides de hormônios femininos; são substâncias estruturais e funcionalmente semelhantes ao 17-ß-estradiol ou que produz efeitos estrogênicos (MENDOZA, et al. 2001). Pouco se sabe sobre os estrogênios presentes nas plantas e os níveis de fito-toxidade dos mesmos, logo na prática torna-se algo difícil de ser observado e atacado. Porém, a nível laboratorial, caso haja alguma complicação que afete o animal para além das capacidades reprodutivas, um diagnóstico aprofundado é o mais indicado. 11.2 Minerais 11.2.1 Iodo (I) Alimentos com baixo teor de iodo, provocam estros silenciosos nos animais e aumentam a incidência de quistos ováricos. O I é parte da molécula de tiroxina que estimula a produção de ATP na mitocôndria, a deficiência reduz a captação de oxigênio o que determina uma diminuição no metabolismo energético. Na tireoide existe um complexo de proteína-iodo, chamado tiroglobulina, essa molécula é uma glicoproteína. A maioria do I é reduzida a iodo inorgânico no trato gastrointestinal e a sua absorção é imediata. A função principal da tireoide é acumular I e fixá-lo, formando hormônios da tireoide sob o controle da adenohipófise por secreção (TSH). O I é convertido em iodeto no trato intestinal e então é transportado para a tireoide, aqui as células foliculares o prendem com efetividade através de um processo de transporte ativo, contra um gradiente de concentração, estimulado por TSH. Uma vez que as hormonas da tireoide controlam o metabolismo, uma deficiência em I diminui a taxa metabólica do organismo, isso afeta indiretamente a reprodução, uma vez que o funcionamento irregular da tireoide afeta a formação de lipídios, esses necessários para a produção de hormônios esteroides (estrogênios) e estes por sua vez influenciam a síntese das prostaglandinas F2-alfa necessária para o processo de luteólise o que faz com que o corpo lúteo não se rompa, perdure e forme um cisto. O I presente no alimento do animal deve estar presente e obedecer o intervalo de 0,34 a 0,88 mg/kg de MS em todos os alimentos que o animal viera a ingerir, seja forragens ou rações. A forma de suplementação são as mais conhecidas, via volumoso, concentrado, água ou pelo sistema SMI. 11.2.2 Manganês (Mn) Níveis elevados de manganês na dieta levam à depleção da absorção de ferro, bem como de outros minerais necessários para a síntese, metabolismo, ativação de enzimas e absorção de outros minerais. Essas interações com outros minerais e o papel do excesso de manganês na inibição da síntese dos precursores de hormonas necessárias para a reprodução, bem como dos metabolitos gerados durante o desdobramento ruminal são representados de forma indireta. Para além do efeito antagônico com outros minerais e enzimas, níveis elevados de manganês provocam uma alteração na população da flora ruminal, o que prejudica a produção de ácido propiônico e butírico a nível ruminal, tendo um efeito negativo no metabolismo dos lipídios com uma subsequente baixa de energia (derivado do metabolismo graxo diminuído ou inibido) e também da síntese de ácidos graxos. Por esta última razão, ocorre uma diminuição na síntese das hormonas esteroides, as quais, não estando presentes em níveis adequados, geram problemas no ciclo estral, uma vez que estas hormonas são essenciais para a síntese das prostaglandinas (PGF2-α) que são necessários para a lise do corpo lúteo, com sua posterior persistência, terminando na formação de um cisto luteal. Como sempre falado nos capítulos dessa compilação de trabalhos, o composto Mn é mais um mineral imprescindível para a alimentação do animal, manutenção normal dos seus mecanismos fisiológicos e relações com outros minerais. Sua disponibilidade para o animal deve ser de 12 a 50 mg/kg de MS das forragens, ou a mesma quantidade no conteúdo da ração balanceada. É um elemento que pode ser colocado na água para absorção pelos animais ou através da suplementação mineral injetável (SMI). 11.2.3 Sódio (Na) Os sinais de deficiência de Na são inespecíficos, mas os mais expressivos são sobre o crescimento e produção leiteira. Numa diminuição do consumo de Na, o organismo ativa os mecanismos de conservação mediados pela liberação de aldosterona que aumenta a reabsorção a nível dos túmulos renais deste mineral. A deficiência de Na afeta a produção de muco cervical, com consequências como problemas na formação de espermatozoides e aumento das infecções uterinas. Dado que a deficiência de Na é rara, apenas os sintomas clínicos desta deficiência mineral podem ser vagamente descritos é k caso da dificuldade de concepção, distorcias e bezerros fracos ao nascimento, além da inatividade ovárica e maior incidência de retenção de placenta. As causas de tais alterações foram motivo de numerosos estudos com resultados contraditórios, as vacas com deficiência de energia no início da amamentação têm diminuição nas concentrações de hormona luteinizante (LH), isto conclui que a alteração ovárica seria determinada por uma alteração da liberação pulsátil de LH devido a uma deficiência energética aguda. A intensidade e a duração do estro são de importância fundamental para a IA nos bovinos. Ao ocorrer uma deficiência de sódio, aumenta-se a estabilização das membranas celulares impedindo que o corpo lúteo se lise, formando-se um cisto, que continuará com a produção de progesterona, levando, por fim, a um anestro patológico. O sódio é um elemento que deve estar disponível aos animais de forma à vontade, ou seja, esse mineral é combinado com o Cl, fazendo o balanceamento eletrolítico e disponibilizado para os animais pelo conhecido sal. Sua administração, como é em sistema à vontade, não é muito controlada, mas o produtor poderá fornecer as quantidades na mistura alimentar do animal, tendo um maior controle da absorção do mesmo pelos animais. Sendo assim, o Na deve ser fornecido em quantidades que obedeçam 0,10 a 0,18% da MS no caso das forrageiras, ou a mesma quantidade misturada no todo da ração, quantidade essa encontrada por meios de cálculos, ou que já vêm na composição da ração industrial. Estudos apontam que um animal deve ingerir cerca de 50 gramas de NaCl por dia, no caso do sódio estar presente em 39% da composição desse cloreto de sódio. Töz problemi Antik Çağ’dan bu yana farklı adlandırmalar, farklı yorumlamalar şeklinde tartışılmaktadır. Bu çalışma, modern felsefenin kurucularından ve rasyonalist düşünürler olan René Descartes’ın epistemolojisinde ve Benedictus Spinoza’nın ontolojisinde oldukça ciddi bir öneme sahip olan töz kavramının neye karşılık geldiğini ve ortaya çıkardığı temel problemleri ele almaktadır. Descartes’ın birden fazla tözün olabileceği fikri ile düalist bir töz anlayışı geliştirdiği yerde, Spinoza Descartes’a bir eleştiri olarak tek bir tözün kabulüne dayalı monist bir töz anlayışı geliştirmiştir. Doğal olarak bu çalışma töz kavramına tarihsel (...) bir çerçeve çizerek, Descartes’ın ruh-beden düalizmine dayanan töz anlayışı ile Spinoza’nın Tanrı temelli töz anlayışını karşılaştırmayı amaçlamaktadır. O ensino de filosofia seguiu uma rota tortuosa desde a colônia até os tempos atuais. O breve histórico desse percurso tem o objetivo de reafirmar a necessidade dessa disciplina no currículo escolar, sobretudo porque sempre há aqueles que a consideram de pouca importância. No entanto, em um mundo cada vez mais pragmático, a formação exclusivamente técnica de nossos jovens dificulta o processo de conscientização crítica, além de desprezar a herança de uma sabedoria milenar. Os primeiros tempos No Brasil, desde o (...) século XVI, o ensino de filosofia fazia parte do chamado curso de artes oferecido pelos jesuítas aos filhos de colonos que concluíam o primeiro nível de letras humanas. É bem verdade que apenas alguns colégios dispunham desse curso, voltado exclusivamente para a elite colonial portuguesa. A base do ensino de filosofia era a tradição escolástica, e, mesmo durante os séculos seguintes, não houve interesse em abordar as conquistas das ciências modernas, já vigentes desde o século XVII, na perspectiva de Francis Bacon e das descobertas de Galileu Galilei. Do mesmo modo, não eram ensinadas as teorias de René Descartes e John Locke. Inspirado nos ideais da Contrarreforma, o ensino jesuítico reafirmava a autoridade da Igreja e dos clássicos, com o controle sobre as informações a que os alunos teriam acesso. No século XVIII, os fundamentos aristotélico-tomistas perduraram, com raras exceções, apesar de o marquês de Pombal ter expulsado os jesuítas. O próprio Pombal permitiu a divulgação de algumas dessas obras "esclarecidas", mas cuidou de elencar uma lista das proibidas. Contrariando o controle, as novas ideias circulavam no Brasil por meio de estudantes formados pela Universidade de Coimbra e também pela venda clandestina de panfletos e cópias manuscritas. Desse modo, nas aulas régias, instituídas por Pombal para substituir as escolas dos jesuítas, no geral foi mantida a educação elitista, livresca, desfocada da realidade brasileira durante o império e a república. Apesar do controle, havia exceções, nas poucas vezes em que intelectuais, professores e conhecedores de bibliografia atualizada ensinavam disciplinas como ciências modernas, filosofia e matemática. Algumas congregações religiosas, como a dos franciscanos, também se interessavam pelas contribuições científicas e filosóficas de seu tempo. Ensino de filosofia: entre facultativa e obrigatória A partir do século XIX, predominou um vaivém entre a filosofia como disciplina obrigatória ou facultativa. Com a criação de cursos jurídicos no Brasil, na década de 1820 - em São Paulo e Recife -, a filosofia tornou-se disciplina obrigatória do ensino médio, como pré- requisito para o ingresso ao curso superior, reforçando o caráter propedêutico daquele curso. Em 1915, uma reforma de ensino tornou a filosofia disciplina facultativa, mas o ministro Francisco Campos tentou reverter esse quadro em 1932, tornando-a novamente obrigatória. Conhecido pela atuação no movimento da Escola Nova, Campos aliou seus esforços aos de figuras importantes da pedagogia brasileira, como o sociólogo Fernando de Azevedo e o filósofo e educador Anísio Teixeira. A tendência escolanovista era renovadora e se fazia necessária diante da situação econômica do Brasil. Com o início da industrialização, surgia a necessidade de melhorar a escolarização, sobretudo para os segmentos urbanos. Francisco Campos introduziu as disciplinas de lógica, sociologia e história da filosofia no currículo escolar. Com a Reforma Capanema, em 19142, o ensino secundário dividiu-se em ginasial e colegial. Este último foi subdividido em científico, com ênfase no estudo de ciências, e clássico, que privilegiava a formação em humanidades. Nesse contexto, a filosofia se constituiu como disciplina obrigatória em um dos três anos do científico e em dois anos do curso clássico, com proposta de programa bastante extenso. No entanto, uma sequência de portarias reduziu gradativamente o número de horas-aula da disciplina, por fim, restrita ao último ano do colegial. Em 1961, foi promulgada a nossa primeira Lei de Diretrizes e Bases da Educação (LDBJ, a Lei n. 4.024, ocasião em que o ensino de filosofia perdeu a obrigatoriedade. Período da ditadura militar Durante a ditadura militar no Brasil (1964-1985), as aulas de filosofia foram extintas pela Lei n. 5.692, de 1971. Essa lei reformou o então chamado ensino de 1º e 2º graus e introduziu o ensino profissionalizante, de acordo com a tendência tecnicista proposta pelos acordos entre militares e tecnocratas. Um dos objetivos era adequar a educação às exigências da sociedade industrial e tecnológica, com economia de tempo, esforços e custos. A educação tecnicista encontrava-se imbuída dos ideais de racionalidade, organização, objetividade, eficiência e produtividade, como se fosse uma empresa: esperava-se que, ao terminar cada um dos níveis, o aluno estivesse capacitado para ingressar no mercado como força de trabalho, caso necessário. Para implantar o projeto de educação proposto, o governo militar não revogou a LDB de 1961, mas introduziu alterações e fez atualizações. Enquanto a aprovação da LDB resultara de amplo debate na sociedade civil, o governo autoritário regulamentou as leis do ensino universitário (Lei n. 5.540/1968) e do ensino de 1º e 2º graus (Lei n. 5.692/1971) de maneira impositiva. Diversos acordos, conhecidos como MEC-Usaid (Ministério da Educação e Cultura e United States Agency for International Development), ofereceram assistência técnica e cooperação financeira para implantar a reforma. A habilitação profissional constituiu-se em um emaranhado de "ofertas" que chegavam a 130 habilitações profissionais distribuídas conforme os cursos e as regiões do país. Algumas disciplinas desapareceram, como a de filosofia, e outras foram aglutinadas. Por sua vez, a inclusão de Moral e Cívica no primeiro nível e de Organização Social e Política no segundo exerceu a clara intenção de doutrinamento político. Há controvérsias em torno da extinção da filosofia do currículo escolar. Para alguns, a extinção revelava a intenção explícita dos governos militares de evitarem o desenvolvimento do pensamento crítico. Outros analisam de modo diferente, alegando que, com raríssimas exceções, o ensino da filosofia reduzia-se à história da filosofia, com ênfase na memorização, não representando, portanto, nenhuma ameaça ao regime de exceção, por desempenhar papel submisso e nada subversivo. Além disso, de acordo com o viés tecnicista da reforma, havia necessidade de mais espaço para incluir disciplinas voltadas para a habilitação profissional. Já nas universidades, era possível notar o crescente desprestígio da filosofia, tendo ocorrido perseguição a professores, muitos deles exilados. Todavia, o propósito de formar profissionais, conforme propunha a nova lei, não se concretizou. A escola pública se fragilizou ainda mais, enquanto algumas boas escolas da rede particular encontraram meios de contornar a lei e oferecer um ensino de qualidade com os mesmos conteúdos que visavam desenvolver o espírito crítico e, portanto, a capacidade de seus alunos pensarem por si mesmos. Em 1982, no clima da abertura democrática, a Lei n. 7.01-114 permitiu a reinserção da filosofia no currículo como optativa, a critério do estabelecimento de ensino. Nada foi conseguido sem esforço, mas com trabalho intenso e pressão da sociedade civil. Associações especialmente criadas para esse fim aglutinaram professores de cursos secundários e superiores para promoverem encontros, movimentos de protesto e contatos com autoridades governamentais, no esforço conjunto para alcançar aquele objetivo. Lei de Diretrizes e Bases da Educação Nacional (LDB) n. 9.394/1996 Após a aprovação da Constituição brasileira de 1988, restava elaborar a lei complementar para tratar das Diretrizes e Bases da Educação Nacional. A primeira LDB, de 1961, levara muito tempo para ser aprovada e ofereceu no final um texto já envelhecido. Devido a esse fato, havia interesse em acelerar a regulamentação da nova LDB, o que ocorreu em dezembro de 1996, com a publicação da Lei n. 9.394. O primeiro projeto da nova LDB baseou-se em amplo debate, não só na Câmara, mas também na sociedade civil, além de várias entidades sindicais, científicas, estudantis e segmentos organizados da educação. O projeto original exigiu do relator Jorge Hage importante trabalho de finalização, já que a nova lei não resultaria de exclusiva iniciativa do Executivo, e sim do debate democrático da comunidade educacional. No entanto, com apoio do governo e do ministro da Educação, o senador Darcy Ribeiro apresentou outro projeto que começara a ser discutido paralelamente e que terminou por ser aprovado. Como ficou a situação do ensino de filosofia? Apesar do movimento consistente que continuava defendendo o retorno da filosofia ao ensino médio, foi grande a decepção. Vejamos por quê. Ao estabelecer as finalidades da educação básica e as diretrizes dos conteúdos curriculares, essa lei destacava a importância da formação para o exercício da cidadania, a difusão de valores fundamentais ao interesse social, aos direitos e deveres dos cidadãos e de respeito ao bem comum e à ordem democrática. Foi recomendado também o aprimoramento do educando como pessoa humana, por meio de formação ética e desenvolvimento da autonomia intelectual e do pensamento crítico. Conforme a LDB sob Lei 9.394/98: Art. 22. A educação básica tem por finalidades desenvolver o educando, assegurar-lhe a formação comum indispensável para o exercício da cidadania e fornecer-lhe meios para progredir no trabalho e em estudos posteriores. Art. 27. Os conteúdos curriculares da educação básica observarão, ainda, as seguintes diretrizes: I – a difusão de valores fundamentais ao interesse social, aos direitos e deveres dos cidadãos, de respeito ao bem comum e à ordem democrática; II – consideração das condições de escolaridade dos alunos em cada estabelecimento; III – orientação para o trabalho; IV – promoção do desporto educacional e apoio às práticas desportivas não- formais. Art. 35. O ensino médio, etapa final da educação básica, com duração mínima de três anos, terá como finalidades: I – a consolidação e o aprofundamento dos conhecimentos adquiridos no ensino fundamental, possibilitando o prosseguimento de estudos; II – a preparação básica para o trabalho e a cidadania do educando, para continuar aprendendo, de modo a ser capaz de se adaptar com flexibilidade a novas condições de ocupação ou aperfeiçoamento posteriores; III – o aprimoramento do educando como pessoa humana, incluindo a formação ética e o desenvolvimento da autonomia intelectual e do pensamento crítico; IV – a compreensão dos fundamentos científico-tecnológicos dos processos produtivos, relacionando a teoria com a prática, no ensino de cada disciplina. Por fim, ficou claro no artigo 36, parágrafo 1º, inciso III (revogado pela Lei n. 11.684, de 2008), que os conteúdos, as metodologias e as formas de avaliação deveriam ser organizados de tal maneira que ao final do ensino médio o educando demonstrasse "domínio dos conhecimentos de filosofia e de sociologia necessários ao exercício da cidadania". Embora a educação para a cidadania constituísse um objetivo visado por qualquer disciplina, com mais razão o professor de filosofia teria condições de abordá-la explicitamente, não só por tomá-la como um de seus conteúdos, mas principalmente pelo seu caráter problematizador e argumentativo, próprio da filosofia. Portanto, seria válido supor que o artigo 36 definisse a reinserção da filosofia no currículo, ministrada por profissional formado na área, o que de fato não se concretizou, e o ensino de filosofia permaneceu como não obrigatório. Posteriormente, conforme a Resolução CEB n. 3/1998, "as propostas pedagógicas das escolas deverão assegurar o tratamento interdisciplinar e contextualizado para os conhecimentos de filosofia e de sociologia necessários ao exercício da cidadania" (artigo 10, parágrafo 2º, alínea b]. Ou seja, professores de outras disciplinas seriam responsáveis por esses "temas transversais", orientação que prevaleceu nos Parâmetros Curriculares Nacionais. Um pouco antes, em 1997, dando continuidade a anseios de educadores, o deputado federal Padre Roque Zimmermann apresentara projeto de lei para tornar obrigatório o ensino de filosofia e sociologia no currículo do ensino médio. Após sua aprovação no Senado, em 2001, o projeto foi vetado pelo então presidente Fernando Henrique Cardoso. Finalmente, em 2008, o artigo 36 da LDB sofreu alteração, tornando obrigatório o ensino de filosofia e de sociologia no currículo do ensino médio, por meio da Lei n. 11.684/2008. Na sequência da aprovação, continua em andamento a implantação desse projeto de ensino. Esperamos que o espaço conquistado não venha a sofrer mais tarde nova retração. In addition to protecting agents’ autonomy, consent plays a crucial social role: it enables agents to secure partners in valuable interactions that would be prohibitively morally risk otherwise. To do this, consent must be observable: agents must be able to track the facts about whether they have received a consent-based permission. I argue that this morally justifies a consent-practice on which communicating that one consents is sufficient for consent, but also generates robust constraints on what sorts of behaviors can be (...) taken as consent- communicating. I argue that the offense generation pattern of slurring terms parallels that of impoliteness behaviors, and is best explained by appeal to similar purely pragmatic mechanisms. In choosing to use a slurring term rather than its neutral counterpart, the speaker signals that she endorses the term. Such an endorsement warrants offense, and consequently slurs generate offense whenever a speaker's use demonstrates a contrastive preference for the slurring term. Since this explanation comes at low theoretical cost and imposes few constraints on (...) an account of the semantics of slurs, this suggests that we should not require semantic accounts to provide an independent explanation of the offense profile. Richard Wollheim famously argued that figurative pictures depict their scenes, in part, in virtue of their ability to elicit a unique type of visual experience in their viewers, which he called seeing-in. According to Wollheim, experiences of seeing-in are necessarily twofold, that is, they involve two aspects of visual awareness: when a viewer sees a scene in a picture, she is simultaneously aware of certain visible features of the picture surface, the picture’s design, and the scene depicted by the picture. (...) Even though Wollheim’s notion of twofoldness has been very influential, a number of philosophers have put forward powerful arguments against it. In this paper, I defend the claim that some pictorial experiences are twofold in Wollheim’s sense. My argument has two parts. In the first part, I provide a phenomenal contrast argument in favor of twofoldness. In the second part, I respond to what I take to be the most important objections against twofoldness. I believe that both parts together provide strong support for the claim that some pictorial experiences are twofold in Wollheim’s sense. (shrink)

A popular informal argument suggests that statistics about the preponderance of criminal involvement among particular demographic groups partially justify others in making defensive mistakes against members of the group. One could worry that evidence-relative accounts of moral rights vindicate this argument. After constructing the strongest form of this objection, I offer several replies: most demographic statistics face an unmet challenge from reference class problems, even those that meet it fail to ground non-negligible conditional probabilities, even if they did, they introduce (...) new costs likely to cancel out any justificatory contribution of the statistic, but even if they didn’t, demographic facts are the wrong sort to make a moral difference to agents’ negative rights. I conclude that the popular argument should be rejected, and evidence-relative theories do not have the worrisome implication. (shrink)

Law-enforcement agencies are increasingly able to leverage crime statistics to make risk predictions for particular individuals, employing a form of inference that some condemn as violating the right to be “treated as an individual.” I suggest that the right encodes agents’ entitlement to a fair distribution of the burdens and benefits of the rule of law. Rather than precluding statistical prediction, it requires that citizens be able to anticipate which variables will be used as predictors and act intentionally to avoid (...) them. Furthermore, it condemns reliance on various indexes of distributive injustice, or unchosen properties, as evidence of law-breaking. (shrink)

A type of argument occasionally made in metaethics, epistemology and philosophy of science notes that most ordinary uses of some expression fail to satisfy the strictest interpretation of the expression, and concludes that the ordinary assertions are false. This requires there to be a presumption in favour of a strict interpretation of expressions that admit of interpretations at different levels of strictness. We argue that this presumption is unmotivated, and thus the arguments fail.

The problem of moral disagreement has been presented as an objection to contextualist semantics for ‘ought’, since it is not clear that contextualism can accommodate or give a convincing gloss of such disagreement. I argue that independently of our semantics, disagreements over ‘ought’ in non-cooperative contexts are best understood as indirect metalinguistic disputes, which is easily accommodated by contextualism. If this is correct, then rather than posing a problem for contextualism, the data from moral disagreements provides some reason to adopt (...) a semantics that allows contextual variance in the meanings of ‘ought’. Some, but not all, of the mistakes a person makes when acting in apparently necessary self-defense are reasonable: we take them not to violate the rights of the apparent aggressor. I argue that this is explained by duties grounded in agents' entitlements to a fair distribution of the risk of suffering unjust harm. I suggest that the content of these duties is filled in by a social signaling norm, and offer some moral constraints on the form such a norm can (...) take. (shrink)

It is often assumed that trolling is an intentional action. The aim of the paper is to argue for a form of unintentional trolling. Firstly, we outline minimal conditions for intentional actions. Secondly, an unintentional trolling example is introduced. Thirdly, we will show that in some cases, an utterance can be expressive, while it is perceived as descriptive. On the basis of the justification-suppression model, we argue that the introduced trolling example is such a case. In order to bypass social (...) sanctions for expressing prejudices, agents unintentionally express their prejudices through stories that appear to be descriptive. Thereby, the characterized behavior does not fulfill the minimal conditions for intentional action. Fourthly, we give criteria that can be used to identify unintentional trolls. Finally, after unintentional trolling is analyzed, the trolls’ behavioral goals are considered. In conclusion, an analysis of unintentional trolling is given, which has explanatory benefits in contrast to the classic intentional trolling concepts. (shrink)

A ‘vestigial social practice' is a norm, convention, or social behavior that persists even when few endorse it or its original justifying rationale. Begby (2021) explores social explanations for the persistence of prejudice, arguing that even if we all privately disavow a stereotype, we might nevertheless continue acting as if it is true because we believe that others expect us to. Meanwhile the persistence of the practice provides something like implicit testimonial evidence for the prejudice that would justify it, making (...) it rational for members of the next generation to acquire the corresponding prejudiced beliefs. This paper distinguishes between three different types of vestigial social practice in terms of the underlying explanatory mechanisms, and argues that the persistence of prejudicial social stereotypes is most tightly linked not to others’ beliefs or expectations, but to the ways that material infrastructure constrains options shapes social outcomes. Given that, the persistence of a practice only provides grounds to infer that most people endorse the corresponding prejudiced belief only if we are in a position to dismiss relevant alternative explanations. Sometimes speakers within a linguistic community use a term that they do not conceptualize as a slur, but which other members of that community do. Sometimes these speakers are ignorant or naïve, but not always. This article explores a puzzle raised when some speakers stubbornly maintain that a contested term t is not derogatory. Because the semantic content of a term depends on the language, to say that their use of t is semantically derogatory despite their claims and intentions, we (...) must individuate languages in a way that counts them as speaking our language L, assigns t a determinately derogatory content in L, and still accommodates the other features of slurs’ linguistic profile. Given the difficulty of doing this, there is some reason to give a non-semantic analysis of the derogatory aspect of slurs. The author suggests that rather than dismissing the stubborn as semantically incompetent, we would do better to appeal to expected uptake as moral reasons for the stubborn to adjust their linguistic practices. In some cases, there appears to be an asymmetry in the evidential value of statistical and more individualized evidence. For example, while I may accept that Alex is guilty based on eyewitness testimony that is 80% likely to be accurate, it does not seem permissible to do so based on the fact that 80% of a group that Alex is a member of are guilty. In this paper I suggest that rather than reflecting a deep defect in statistical evidence, this (...) asymmetry might arise from a general constraint on rational inquiry. Plausibly the degree of evidential support needed to justify taking a proposition to be true depends on the stakes of error. While relying on statistical evidence plausibly raises the stakes by introducing new kinds of risk to members of the reference class, paradigmatically `individualized' evidence---evidence tracing back to A's voluntary behavior---can lower the stakes. The net result explains the apparent evidential asymmetry without positing a deep difference in the brute justificatory power of different types of evidence. (shrink)

​I evaluate a suggestion, floated by Kimberly Ferzan (this volume), that the twitter hashtag campaign #BelieveWomen is best accommodated by non-reductionist views of testimonial justification. I argue that the issue is ultimately one about the ethical obligation to trust women, rather than a question of what grounds testimonial justification. I also suggest that the hashtag campaign does not simply assert that ‘we should trust women’, but also militates against a pernicious striking-property generic (roughly: ‘women make false sexual assault accusations’), that (...) distorts our evaluation of women’s testimony concerning sexual assault. I conclude #BelieveWomen does not demand that we believe against the evidence, or uncritically, or be more trusting than we have evidential justification to be. Rather, it aims to bring our trust closer to what is merited by the base-rate of reliable testimony from women concerning sexual assault. (shrink)

In this article, I contribute to the debate between two philosophical traditions—the Kantian and the Aristotelian—on the requirements of criminal responsibility and the grounds for excuse by taking this debate to a new context: international criminal law. After laying out broadly Kantian and Aristotelian conceptions of criminal responsibility, I defend a quasi-Aristotelian conception, which affords a central role to moral development, and especially to the development of moral perception, for international criminal law. I show than an implication of this view (...) is that persons who are substantially and non-culpably limited in their capacity for ordinary moral perception warrant an excuse for engaging in unlawful conduct. I identify a particular set of conditions that trigger this excuse, and then I systematically examine it as applied to the controversial case of former-child-soldier-turned leader of the Lord’s Resistance Army, Dominic Ongwen, who is currently at trial at the International Criminal Court. Recently, an increasing number of scholars have been showing interest in old-fashioned racism again. While recent studies on old-fashioned racism apparently increase our knowledge of this psychological theory of racism, the studies actually shed light on a different type of racism, namely offensive racism. The aim of this text is to argue that psychological theories of racism, like old-fashioned racism and modern racism, depend on societies’ social norms. I will show that questionnaires are highly sensitive to social norms, and if (...) there is change in social norms, the original measurement object alters. The theory of old-fashioned racism implicitly assumes agents that follow (or conform to) the social norm to behave prejudiced. Today, however, this social norm does not exist in Western societies. If agents express the same prejudices today, they indicate their willingness to breach the social norm to behave unprejudiced. Thereby, classic old-fashioned racism measures reflect a new kind of racism today. (shrink)

There has been recent discussion of a puzzle posed by emotions that are backward looking. Though our emotions commonly diminish over time, how can they diminish fittingly if they are an accurate appraisal of an event that is situated in the past? Agnes Callard (2017) has offered a solution by providing an account of anger in which anger is both backwards looking and resolvable, yet her account depends upon contrition to explain anger’s fitting diminishment. My aim is to explain how (...) anger can fittingly diminish even when there is lack of contrition. I propose a permissivism about fittingness by showing that both anger and compassion are fitting responses to blameworthy behaviour. I argue that anger is rendered fitting because it accurately appraises the behaviour, whereas compassion becomes fitting as a valuational response to what the behaviour reveals about the lived experience of the offender. I then respond to some worries my account raises, and I clarify details of my account to show that it is not unrealistic to the way some of our anger actually does diminish. I end with a proposal that our anger can fittingly diminish through the act of forgiveness when compassion is not a forthcoming affective response. (shrink)

Skeptical theists are seeking for some reasonable solutions to the evidential problem of evil. One of the most fundamental responses of skeptical theism is that the concept of “gratuitous evil”, which cannot be a proof of the absence of God. Therefore, it is not the existence of God that skeptical theism suspects. Instead, skeptical theism contemplates whether the evil in the world really has a “gratuitous” basis. This paper focuses on Peter van Inwagen's “no-minimum claim”. No-minimum claim” stands in opposition (...) to the views that assume that God minimizes the evils that exist in the world in order to achieve justice. “No-minimum claim” acknowledges that these evils still have enormous amounts to people. Thus “no-minimum claim” suggests that the evils experienced in the world are incompatible with the “best of all possible worlds” views or the other explanations of classical theodicy. According to the “no minimum claim”, the reason why the amount of evil in the world still seems so high may be God’s deliberate calculations in effecting the distribution of these evils. In order to reach these calculations, it is not necessary for the amount of evil that God allowed to reflect on the world to be perfectly manifested at the minimum level. The purpose of this paper is to consider the skeptical theism approach within the framework of Peter van Inwagen's “no-minimum claim” and to limit his arguments to an alternative approach to skeptic theism. Our claim is that such view coincides with skeptical theism, but the “no- minimum claim” still has some ambiguities at the point of the limits of evil. From this, we can conclude that the “no minimum claim” has received many objections in the skeptical theism literature and these objections are justified at certain points. (shrink)

A common view in the philosophy of perception holds that states of seeing objects face to face have particular contents. When you see, say, a dog face to face, your visual state represents the particular dog that is in front of you. In this paper, I argue for a related claim about states of seeing objects in conventional photographs. When you see a dog in a photograph, for example, your visual state represents the particular dog that was in front of (...) the camera when the photograph was taken, that is, the photograph's depictum. The argument in this paper proceeds in two steps. In the first step, I discuss states of seeing objects face to face. I argue that such a state represents the particular object whose surface is responsible for the optical information that the visual system uses to construct the state's attributive representational content. In the second step, I apply the result of this discussion to states of seeing objects in photographs. I argue that a state of seeing an object in a photograph has a particular content that represents the object that was in front of the camera when the photograph was taken. (shrink)

How is it possible for a picture to depict a picture? Proponents of perceptual theories of depiction, who argue that the content of a picture is determined, in part, by the visual state it elicits in suitable viewers, that is, by a state of seeing-in, have given a plausible answer to this question. They say that a picture depicts a picture, in part, because, under appropriate conditions of observation, a suitable viewer will be able to see a picture in the (...) picture. In this article, I first argue that this answer is in conflict with the way in which some of the most influential perceptual theories of depiction – Robert Hopkins's version of the experienced resemblance theory and Dominic Lopes's version of the recognition theory – construe seeing-in. I then formulate a version of the recognition theory that avoids this conflict and show how it can explain the depiction of pictures. (shrink)

This paper surveys some philosophical issues with the language surrounding mental illness, but is especially focused on pejoratives relating to mental illness. I argue that though 'crazy' and similar mental illness-based epithets (MI-epithets) are not best understood as slurs, they do function to isolate, exclude, and marginalize members of the targeted group in ways similar to the harmfulness of slurs more generally. While they do not generally express the hate/contempt characteristic of weaponized uses of slurs, MI-epithets perpetuate epistemic injustice by (...) portraying sufferers of mental illness as deserving minimal credibility. After outlining the ways in which these epithets can cause harm, I examine available legal and social remedies, and suggest that the best path going forward is to pursue a reclamation project rather than aiming to censure the use of MI-epithets. Recent global efforts of the United States and England to withdraw from international institutions, along with recent challenges to human rights courts from Poland and Hungary, have been described as part of a growing global populist backlash against the liberal international order. Several scholars have even identified the recent threat of mass withdrawal of African states from the International Criminal Court (ICC) as part of this global populist backlash. Are the African challenges to the ICC part of a global populist (...) movement developing in Africa? More fundamentally, how are the African challenges to the ICC examples of populism, if at all? In this paper, I show that, while there is considerable overlap between the strategies used by particular African leaders to challenge the ICC and those typically considered populist, as well as a discernible thin populist ideology to sustain them, there is insufficient evidence of a larger anti-ICC populist movement in Africa. Although Africa is not as united against the ICC as the populist narrative suggests, the recent challenges to the Court from Africa pose a significant challenge to the Court, as the institution is still in the early stages of building its legitimacy. This paper describes an undergraduate course in metaphilosophy for philosophy majors and argues that there are four potential benefits to students; namely that doing metaphilosophy (1) allows students to draw their own conclusions about what philosophy is, (2) develops students’ metacognitive skills to promote learning, (3) establishes students as members of the philosophical community, and (4) disposes students to live lives that reflect their philosophical education. It describes issues of transparency of course design and the particulars of the course, including (...) course content, and provides excerpts of student work to demonstrate student learning outcomes. Finally, it will suggest that even if it is not possible to offer a stand-alone course in metaphilosophy, instructors should provide opportunities to reflect on metaphilosophical issues in their other philosophy courses. This paper examines whether American parents legally violate their children’s privacy rights when they share embarrassing images of their children on social media without their children’s consent. My inquiry is motivated by recent reports that French authorities have warned French parents that they could face fines and imprisonment for such conduct, if their children sue them once their children turn 18. Where French privacy law is grounded in respect for dignity, thereby explaining the French concerns for parental “over-sharing,” I show (...) that there are three major legal roadblocks for such a case to succeed in US law. First, US privacy tort law largely only protects a person’s image where the person has a commercial interest in his or her image. Secondly, privacy tort laws are subject to constitutional constraints respecting the freedom of speech and press. Third, American courts are reluctant to erode parental authority, except in cases where extraordinary threats to children’s welfare exist. I argue that while existing privacy law in the US is inadequate to offer children legal remedy if their parents share their embarrassing images of them without their consent, the dignity-based concerns of the French should not be neglected. I consider a recent proposal to protect children’s privacy by extending to them the “right to be forgotten” online, but I identify problems in this proposal, and argue it is not a panacea to the over-sharing problem. I conclude by emphasizing our shared social responsibilities to protect children by teaching them about the importance of respecting one another’s privacy and dignity in the online context, and by setting examples as responsible users of internet technologies. Are words like ‘woman’ or ‘man’ sex terms that we use to talk about biological features of individuals? Are they gender terms that we use to talk about non-biological features e.g. social roles? Contextualists answer both questions affirmatively, arguing that these terms concern biological or non-biological features depending on context. I argue that a recent version of contextualism from Jennifer Saul that Esa Diaz-Leon develops doesn't exhibit the right kind of flexibility to capture our theoretical intuitions or moral and political (...) practices concerning our uses of these words. I then float the view that terms like 'woman' or 'man' are polysemous, arguing that it makes better sense of the significance of some forms of criticisms of mainstream gender ideology. (shrink)

The most notable contributions to contemporary philosophy of mind have been written by philosophers of mind for philosophers of mind. Without a good understanding of the historical framework, the technical terminology, the philosophical methodology, and the nature of the philosophical problems themselves, not only do undergraduate students face a difficult challenge when taking a first course in philosophy of mind, but instructors lacking specialized knowledge in this field might be put off from teaching the course. This paper is intended to (...) provide a framework for instructors with little background in this area of philosophy to develop a course in philosophy of mind. This course, aimed at the advanced undergraduate student, provides students with the tools necessary for understanding some of the key readings in contemporary philosophy of mind and offers unique benefits to both majors and non-majors. The course described here focuses on just two of the main problems in philosophy of mind—the mind-body problem and the problem of phenomenal consciousness—and briefly touches on other issues one might address. Finally, several solutions to common challenges that arise in an advanced philosophy course are discussed. (shrink)

A partir del cruce de los esquemas relativos a la presencia en general y los fines del humanismo, el análisis se concentra en la referencia a la epokhé en ambos prolegómenos de 1968. Al insistir en la esquematización preliminar, el comentario insinúa el programa de lectura implicado en el seguimiento mimético de las mallas semánticas.

Recently, psychologists have developed indirect measurement procedures to predict suicidal behavior. A prominent example is the Death/Suicide Implicit Association Test (DS-IAT). In this paper, I argue that there is something special about the DS-IAT which distinguishes it from different IAT measures. I argue that the DS-IAT does not measure weak or strong associations between the implicit self-concept and the abstract concept of death. In contrast, assuming a goal-system approach, I suggest that sorting death-related to self-related words takes effort because death-related (...) words trigger avoidance-impulses, which suicide ideation weakens. The DS-IAT taps into weakened automatic responses from the self-preservation system. Additionally, the suggested cognitive structure, illuminated with the selfish-goal theory, explains predictable suicidal behavior. (shrink)

The identification of plausible epistemic approaches in science as well as the social problem definitions with which scientists implicitly work is essential for the quality of a deliberative public policy. While responding to the Nanofutures project, I will reflect on the essential elements of such a policy.

This study asserts that W.V.O. Quine’s eliminative philosophical gaze into mereological composition affects inevitably his interpretations of composition theories of ontology. To investigate Quine’s property monism from the account of modal eliminativism, I applied to his solution for the paradoxes of de re modalities’ . Because of its vital role to figure out how dispositions are encountered by Quine, it was significantly noted that the realm of de re modalities doesn’t include contingent and impossible inferences about things. Therefore, for him, (...) all the intrinsic forces and elements of entities such as powers and causal or teleological dispositions for ontology demand to be seen necessarily as bound variables from a monist perspective. Although his denial of analyticity and the elimination of dispositional field of ontology, S. Mumford criticizes the monist perspective of Quine’s paradoxical approach to superveniences. Because superveniences create problems while determining type-type identities from a monist mereological perspective. It is observed that Quine faces with a reduction again in terms of his dispositional monism despite his critiques to repulse vagueness from the ontology in his well-known article Two Dogmas of Empiricism. -/- . Responsible Research and Innovation (RRI) reflects an innovation paradigm that acknowledges that market innovations do not automatically deliver on socially desirable objectives, and requires a broad governance of knowledge coalitions of governmental bodies as well as industrial and societal actors to address market deficits. Responsible Innovation should be understood as a new paradigm for innovation which requires institutional changes in the research and innovation system and the public governance of the economy. It also requires the institutionalisation of an ethics of (...) co-responsibility as well as the introduction of new standards and certification processes for products. Dr. Dr. phil. von Schomberg will introduce Responsible Innovation against the background of 6 deficits of the (global) research and innovation system. (shrink)

On the basis of Karl-Otto Apels’ diagnosis of the shortcomings of philosophical ethics in general, and any ethics of individual accountability in particular, I give an outline how these shortcoming are currently to be articulated in the context of ecological crisis and socio-technical change. This will be followed with three interpretations of Karl-Otto Apels’ proposal for an ethics of collective coresponsibility. In conclusion, I will advocate that only a further social evolution of the systems of science, economy and law will (...) enable a possible institutionalization of collective co-responsibility by means of a new innovation paradigm: responsible innovation. I argue that legitimacy discourses serve a gatekeeping function. They give practitioners telic standards for riding herd on social practices, ensuring that minimally acceptable versions of the practice are implemented. Such a function is a necessary part of implementing formalized social practices, especially including law. This gatekeeping account shows that political philosophers have misunderstood legitimacy; it is not secondary to justice and only necessary because we cannot agree about justice. Instead, it is a necessary feature of actual human social practices, (...) which must be implemented via practitioners' discretion in changing contexts. (shrink)

The essays collected in this special issue explore what legitimacy means for actors and institutions that do not function like traditional states but nevertheless wield significant power in the global realm. They are connected by the idea that the specific purposes of non-state actors and the contexts in which they operate shape what it means for them to be legitimate and so shape the standards of justification that they have to meet. In this introduction, we develop this guiding methodology further (...) and show how the special issue’s individual contributions apply it to their cases. In the first section, we provide a sketch of our purpose-dependent theory of legitimacy beyond the state. We then highlight two features of the institutional context beyond the state that set it apart from the domestic case: problems of feasibility and the structure of international law. (shrink)

We reflect on a decade of Responsible Research and Innovation (RRI) as a discourse emerging from the European Commission (EC) 10 years ago. We discuss the foundations for RRI, its emergence during the Seventh Framework programme and its subsequent evolution during Horizon 2020. We discuss how an original vision for RRI became framed around five so-called ‘keys’: gender, open access, science communication, ethics and public engagement. We consider the prospects for RRI within the context of the EC’s Open Science agenda (...) and Horizon Europe programme, before closing with some reflections on the contribution RRI has made to debates concerning the relationship between science, innovation and society over the last decade. This work is driven by the attempt to criticise Phenomenology with the help of Levinas. Similar to the Frankfurt School, he characterises it as a “vision of essences”. These eidetical essences are, and can never be fully absolute, not only because several movements of Hegelian Dialectics are refuted in submitting knowledge either to the imago of mere immanence, or to normative structures which are postulated as invariant like in certain versions of Neoplatonism, but because they function as an apriori of (...) an eternally unfinished and fragmented Lebenswelt. Maybe it is to harsh to compare Husserl to the neoscholastic readings of Descartes and to the formalist interpretations of Kant. Husserl is well aware of the kinaesthetic foundations of consciousness and, contrary to Heidegger, he even promotes Spinozism in a certain phase of his work which excels his adolescent fervour of Berkeley. Nevertheless, Husserl incorporates a subject-based, “monadic” transcendentalism, that paradoxically leads to the dissolution of subjective identity. Traditional reasoning itself is exfoliated to perfection in Heidegger afterwards. Husserl's halfhearted formalism ignores the materialist theory of the simulacrum by Lucretius. Heideggers philosophy widens this overseen aspect in calling the Eidos an Aussehen in referring to the Presocratics, but it despises any kind of method and finally flees in to poetry, maintaining its fatalist errors which it committed right form the start: this is why it gained the name of pseudo-concreteness. Cursed through a specific anti-sociological tendency caused by an anti-empiricist vision of history, their theories virtually (not conceptually) exclude the influences of society on philosophy: they are the end result of the era of Kulturkampf, in which idealism tried to battle positivism, naturalism and historicism. Husserl even defines this philosophical battle as the very struggle of existence. The formulation of the Eidos becomes performance. Aristotle used Eidos synonymous to genus and species. Hence the amplitudes of these philosophies foster the metaphysical standpoint of race, that got out of hand in the Nazi Era and even later on. The “topic” of blood and soil appears in Husserl's definition of Heimwelt and his Eurocentrism. Phenomenology is in no case to blame for National Socialism, and it has very little to to with its causes. My work simply tries to make the same analogy that Marx had made for Hegel. It tries to describe, how two leading philosophers of the German Bourgeoisie are reproducing the categories of their surrounding society without even really observing it. (shrink)

Institutions undertake a huge variety of constitutive purposes. One of the roles of legitimacy is to protect and promote an institution’s pursuit of its purpose; state legitimacy is generally understood as the right to rule, for example. When considering legitimacy beyond the state, we have to take account of how differences in purposes change legitimacy. I focus in particular on how differences in purpose matter for the stringency of the standards that an institution must meet in order to be legitimate. (...) An important characteristic of an institution’s purpose is its deontic status, i.e. whether it is morally impermissible, merely permissible, or mandatory. Although this matters, it does so in some non-obvious ways; the mere fact of a morally impermissible purpose is not necessarily delegitimating, for example. I also consider the problem of conflicting, multiple, and contested institutional purposes, and the different theoretical roles for institutional purpose. Understanding how differences in purpose matter for an institution’s legitimacy is one part of the broader project of theorizing institutional legitimacy in the many contexts beyond the traditional context of the state. I develop a cognitive account of how humans make skeptical judgments (of the form “X does not know p”). In my view, these judgments are produced by a special purpose metacognitive "skeptical" mechanism which monitors our reasoning for hasty or overly risky assumptions. I argue that this mechanism is modular and shaped by natural selection. The explanation for why the mechanism is adaptive essentially relies on an internalized principle connecting knowledge and action, a principle central to pragmatic encroachment theories.
